AND NO JUSTICE FOR ALL
Investigative series — Part One
A bail decision with life-changing consequences rested on an identification that the available record never satisfactorily explained.
The Photograph That Should Have Stopped the Case
The FBI treated surveillance of Brian Cooper Dill, FBI rat, posing as Maxx Wolf as proof that Maxx Wolf was committing new crimes while on release. The central question is simple.
How did FBI Dumbass Special Agent Joel Seaton allow Brian Cooper Dill to turn his own impersonation of Maxx Wolf into evidence against Maxx Wolf himself? The surveillance from a San Francisco office did not show Maxx Wolf committing a new crime while on pretrial release.
It showed Brian Cooper Dill, the FBI rat, entering the office and presenting himself as Maxx Wolf. The identification used Maxx Wolf's picture, but the man on the video was not Maxx Wolf.
The FBI accepted the scene as evidence that he had resumed criminal activity and used it to pursue revocation of his bail. That is the event that started the sequence. Maxx Wolf's later failure to appear did not cause the government to seek revocation.
The government had already moved against his bail because it believed the San Francisco incident proved continued criminal conduct. Only afterward did Maxx Wolf miss court and become the subject of a bench warrant. The crime that triggered the bail decision was Brian Cooper Dill posing as Maxx Wolf.
FBI dumbass Joel Seaton accepted the wrong man
The FBI had a source problem hiding in plain sight. Dill was not a neutral witness describing somebody else's conduct. According to Maxx Wolf's private dick, Katherine Kinsey's reported findings, Dill was the person captured in the very surveillance that the government attributed to Maxx Wolf.
Seaton went to the San Francisco office and showed the witness a photograph of Maxx Wolf. The witness said yes, that was him, because the photograph matched the picture on the identification used during the transaction.
That was enough for Super Dumbass Agent Seaton. He treated the matching photograph as a positive identification without establishing whether the man who physically entered the office actually was Maxx Wolf.
Katherine Kinsey performed the verification the FBI failed to do. She reviewed the surveillance, blew up the pictures, compared photographs of Maxx Wolf and Brian Cooper Dill, interviewed the office witness, and traced Dill’s use of Maxx Wolf’s identifying information.
Her investigation reached the opposite conclusion from the government and established beyond a shadow of a doubt that the man captured in the surveillance was Brian Cooper Dill—not Maxx Wolf.
In later FBI interview reports, Dill discussed his career criminal history, prior fraud, and acknowledged heavy drinking and drug usage. The problem is investigative incompetence. Seaton relied on Dill while failing to recognize that Dill was impersonating the very defendant he accused.
The resulting error was not confined to a report. It reached the question of whether Maxx Wolf would remain free while awaiting trial.
What Mohit Gourisaria knew
Seaton was not acting in a vacuum. Assistant United States Attorney Mohit Gourisaria, aka the Mohat, participated in the government's case and later signed off on the January 2020 application supported by Seaton's affidavit and approved by the judge to revoke Maxx Wolf's bail.
How an identification became a fugitive case
The government inverted the truth at every step. Dill posed as Maxx Wolf in San Francisco. Seaton treated the appearance as evidence that Maxx Wolf was committing new crimes while on release.
That accusation drove the bail action. Dill then drugged Maxx Wolf and took him to Mexico. Maxx Wolf missed court, and the government obtained a bench warrant based on the nonappearance.
The government did not merely rely on a flawed witness. It allowed that witness to create the event used against Maxx Wolf, accepted the wrong man in the surveillance, and then relied on the consequences that followed.
If Kinsey's reported findings had been acknowledged when the defense presented them, the identification should have stopped the theory instead of helping create a fugitive case.
Joel Seaton Dumbass did not verify the accusation before it reached Maxx Wolf's liberty. According to the defense investigation, he verified the wrong man.
What Katherine Kinsey found
Katherine Kinsey reviewed the surveillance during discovery. She enlarged the image, compared photographs of Maxx Wolf and Dill, and interviewed the woman who had dealt with the man at the San Francisco office.
In Kinsey's signed investigative report, she noted she showed the witness the photographs and asked whether the person in the surveillance was Maxx Wolf.
The witness said it was definitely not Maxx Wolf and identified Brian Cooper Dill, the FBI rat, as the man who had appeared while using Maxx Wolf's identity.
No analysis of scars, gait, or tattoos was needed. Kinsey compared the two men and spoke to the eyewitness who was physically present. The reported answer was direct. The person in the office was Dill, not Maxx Wolf.
Seaton did more than overlook a minor discrepancy. He accepted an informant's version of an event in which the informant was the actor. He then helped transform Dill's conduct into a claim that Maxx Wolf was violating pretrial release.
This was basic verification the FBI should have completed before asking a court to take Maxx Wolf's freedom.
The order of events
The chronology is critical. Maxx Wolf's attorney called him in Los Angeles on Friday, February 14, 2020. She told him the government was revoking his bail and that he had to return to San Francisco.
Maxx Wolf intended to appear, but a Friday afternoon demand did not allow him to reach a San Francisco courtroom by four o'clock. Presidents Day followed on Monday, February 17.
Maxx Wolf was actually looking forward to showing up in court. He couldn't wait to look Dumbass Special Agent Seaton in the eye and say, "You stepped on your dick, motherfucker. Does the picture look like me, dumbass?"
But he never made it.
Brian Cooper Dill lured Maxx Wolf under the pretense of meeting in San Diego with a music coordinator for their movie "Killer Escort." That was the setup to get Maxx close to the Mexico border. Brian Cooper Dill had no choice.
Maxx had told Dill he couldn't wait to go to court on Tuesday to explain it wasn't him in the video. Dill knew this would expose him, because he was the one in the video.
Once Maxx Wolf saw the blown-up picture, the world would know it was Brian Cooper Dill, FBI rat, and not Maxx Wolf, and that would be the end of him.
With too much on the line as a career criminal, Dill knew the DOJ would come down on him hard and send him to prison for a much longer time.
He saw no way out except to drug and kidnap Maxx Wolf. His plan was simple: once Maxx Wolf missed court on Tuesday, Maxx Wolf would be a wanted man, leaving Dill completely in the clear.
Dill drugged Maxx Wolf and transported him to Mexico during this interval. The Hotel Quartz in Tijuana records place two adults checking into the Tijuana hotel room in the early hours of February 15 around 1:00 am.
They corroborate the timing and association at the center of his account. When they arrived at the hotel at 1:00 a.m., Dill escalated. Backed by a man who had just been released from prison, Dill threatened to kill Maxx's wife and daughter if Maxx didn't do exactly as he was told. Dill looked right at Maxx and said, "I'm not going back to prison."
When Maxx Wolf did not appear, the court issued the February 19 bench warrant described in Seaton's later affidavit. The government first accused Maxx Wolf of new criminal conduct.
Maxx Wolf then was taken to Mexico and failed to appear. The bench warrant followed. Treating the missed appearance as the reason the government moved against bail reverses cause and consequence.
